1. Who We Are

Verto Marketing (“Verto”, “we”, “us” or “our”) is a digital marketing agency based in Brampton, Ontario, serving businesses across Canada. We operate vertomarketing.ca and provide website design and development, performance marketing, search optimization, business automation, lead generation and branding services. Verto is responsible for the personal information under its control and has appointed a Privacy Officer, named at the end of this policy, who is accountable for our compliance.

2. What This Policy Covers

This policy applies to personal information we collect through vertomarketing.ca and its free tools, our chat assistant, forms, bookings, emails, phone calls, text and WhatsApp messages, social media and our work with clients. It does not cover information about businesses that is not about an identifiable individual, or third-party websites we link to.

3. Information We Collect

We collect only the information we need for the purposes described in this policy.

  • Contact details: your name, business name, email address, phone number, city and website address.
  • Enquiry and booking details: your goals, business type, the services you are interested in, preferred meeting times, meeting method (phone, Zoom, Microsoft Teams or in person) and, for in-person visits, the address you give us.
  • Free tool answers and results: the answers you enter in our audits, assessments, planners and calculators, and the reports, scores and plans we create from them.
  • Public business information: when you request an audit, we review publicly available information such as your website, page speed, security status, search visibility and public Google Business Profile details, including ratings and reviews.
  • Chat assistant messages: the questions and details you type or say to Verto Assistant, our on-site assistant. If you share your contact details in the chat, we save the conversation with your enquiry so our team can follow up with you.
  • Verification information: your email address or mobile number and the one-time code used to confirm it.
  • Client information: if you become a client, billing contacts, project details, content and files you share, and the access you grant us to your advertising, analytics, website or other business accounts.
  • Technical and usage information: IP address, device and browser type, pages viewed, links clicked, referring website, approximate location and the date and time of visits, collected through cookies and similar technologies.
  • Communications: emails, messages and call notes when you contact us.

4. How We Use Your Information

  • To respond to your enquiries and provide the information, report, plan or quote you request.
  • To schedule and hold consultations and send confirmations and reminders.
  • To verify your email or phone number and protect our forms and free tools from spam, abuse and automated misuse.
  • To deliver, manage and improve the services you buy from us, including reporting on results.
  • To send invoices and keep business, tax and accounting records.
  • To send marketing messages when you have agreed to receive them.
  • To understand how our website is used, fix problems and improve our content, tools and services.
  • To measure and improve our own advertising.
  • To meet legal obligations and protect our rights, our clients and the public.

We will not use your personal information for a new purpose without first telling you and, where required, asking for your consent.

We collect, use and share personal information with your consent, except where the law allows otherwise. You give express consent when you tick a consent box, submit a form or opt in to messages. Consent may be implied where the purpose is obvious, for example when you email us and we reply. You may withdraw consent at any time, subject to legal or contract limits; we will explain the effect, for example that we may not be able to complete a request without certain details.

6. Free Tools, AI and Automated Checks

Our free tools combine your answers with automated checks from third-party services, such as Google PageSpeed Insights, Google Places and Google Web Risk. Some reports and our chat assistant use an artificial intelligence (AI) model to review your public website and the details you give us and to write recommendations. We send these services only the information needed to produce the result. Reports are estimates for planning purposes and are reviewed by our team before any paid work begins.

To keep free tools fair, we may limit reports to one per website within a set period, check whether a request comes from another marketing agency, and decline requests that appear to misuse the tools. These checks use the email domain and website you provide and do not have legal or similarly significant effects on you.

7. Email and Phone Verification

Some forms ask you to confirm your email address or mobile number with a one-time code. Email codes are sent by our email provider. Text-message codes are sent through Twilio, our messaging provider. We use your number or address only to send the code and to contact you about your request, unless you separately agree to marketing messages. Standard message and data rates may apply.

8. Marketing Messages (CASL)

We only send commercial emails, texts or WhatsApp messages when we have your consent or another basis permitted by CASL, and we keep a record of when and how consent was given. Every marketing message identifies Verto Marketing, includes our contact details and offers a simple way to unsubscribe. You can unsubscribe at any time by using the link in an email, replying STOP to a text message, or contacting us. We act on unsubscribe requests within 10 business days. We may still send messages that relate directly to a request you made, such as your report, booking confirmation or project updates.

9. Cookies, Analytics and Advertising

Cookies are small files stored on your device. We and our partners use them and similar technologies for the following purposes:

  • Essential: to run the website, keep forms secure and remember your cookie choices. These cannot be turned off.
  • Preferences: to remember settings, such as whether the chat assistant speaks its answers.
  • Analytics: to understand how visitors use the site, using tools such as Google Analytics.
  • Advertising: to measure our ads and show relevant ads on platforms such as Google and Meta (Facebook and Instagram).

Non-essential cookies are used only in line with the choices you make in our cookie banner. You can change your choices at any time through our cookie banner or your browser settings, and you can learn more about Google’s ad settings at adssettings.google.com. Blocking some cookies may affect how the site works.

10. Notifications and Browser Storage

If you allow browser notifications, your browser gives us a subscription token so we can send updates such as new articles. You can turn notifications off at any time in your browser or device settings. Our chat assistant may remember your first name and conversation preferences in your own browser’s storage so it can greet you on your next visit; you can clear this with the “Forget me” option in the assistant or by clearing your browser data. If you use voice input, your browser’s speech recognition service converts your voice to text.

11. Who We Share Information With

We do not sell or rent your personal information. We share it only as described below and only as much as needed:

  • Service providers that help us run our business, such as website hosting and content delivery, email delivery, text-message and verification services, booking and calendar tools, video meeting tools, customer relationship management, analytics, advertising platforms, AI services, and accounting and payment providers. They may use the information only to provide services to us and must protect it.
  • Advertising and analytics platforms, such as Google and Meta, which receive technical and usage information through cookies, in line with your cookie choices.
  • Professional advisers, such as accountants and lawyers, where needed.
  • Legal and safety reasons: when required by law, court order or a government authority, or to protect our rights, property or safety, or that of others.
  • Business transfers: if our business is sold or merged, personal information may transfer to the new owner, who must continue to protect it under this policy.

12. Storage Outside Canada

Some of our service providers store or process information outside Canada, including in the United States and other countries. While there, the information is protected by our agreements with those providers but may be accessible to courts, law enforcement and national security authorities under the laws of those countries.

13. How Long We Keep Information

We keep personal information only as long as needed for the purposes it was collected for, or as required by law. As a general guide:

  • Enquiries, bookings and free tool reports that do not lead to client work: up to 24 months after our last contact.
  • Marketing consent records: for as long as you are subscribed and for 3 years after you unsubscribe, to show compliance with CASL.
  • Client project and billing records: for at least 7 years after the end of the engagement, to meet tax and accounting rules.
  • Verification codes: deleted automatically shortly after use or expiry.

When information is no longer needed, we securely delete it or make it anonymous.

14. How We Protect Information

We use reasonable physical, organisational and technical safeguards suited to the sensitivity of the information, including encrypted connections (HTTPS), password-protected and access-limited systems, verification of sign-up details, and trusted service providers. Only people who need the information to do their work can access it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

15. Privacy Breaches

If a breach of security safeguards involving your personal information creates a real risk of significant harm, we will notify you and report it to the Office of the Privacy Commissioner of Canada as required by PIPEDA, and we will keep a record of the breach.

16. Your Privacy Rights

You have the right to:

  • Ask whether we hold personal information about you and request a copy of it.
  • Ask us to correct information that is inaccurate or incomplete.
  • Withdraw your consent to our use of your information, including for marketing.
  • Ask us to delete your information, unless we must keep it for legal or contract reasons.
  • Ask how your information is used and who it has been shared with.

To make a request, contact our Privacy Officer using the details below. We may need to verify your identity first. We will respond within 30 days, or tell you if we need more time as permitted by law. If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada. Residents of Quebec may also have rights under Quebec’s private-sector privacy law.

17. Children

Our website and services are intended for business owners and adults. We do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, please contact us and we will delete it.

Our site may link to other websites and platforms, such as Google, Meta, LinkedIn or booking providers. We are not responsible for their privacy practices, and we encourage you to read their privacy policies.

19. Changes to This Policy

We may update this policy from time to time to reflect changes in our services or the law. The “Last updated” date at the top shows when it was last changed. If we make significant changes, we will post a notice on this page and, where required, ask for your consent.
